{"id":5338,"date":"2020-01-17T09:51:19","date_gmt":"2020-01-17T09:51:19","guid":{"rendered":"http:\/\/dslsa.org\/sed\/?p=5338"},"modified":"2020-01-17T09:57:16","modified_gmt":"2020-01-17T09:57:16","slug":"5338","status":"publish","type":"post","link":"http:\/\/dslsa.org\/sed\/5338\/","title":{"rendered":"&#8220;Assisting Child in the School&#8221;"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\">Sh Sanjay Datt<\/span><\/p>\n<p style=\"text-align: center;\">Success Story<\/p>\n<p>I have been associated since last three years and felt proud member being part of umbrella Legal Aid Services of Delhi State Legal Services Authority, previously known as DLSA, South East, District Courts, Saket, New Delhi.\u00a0 As Legal Aid is the provision of assistance to people otherwise unable to afford legal representation and access to the court system and justice.<\/p>\n<p><strong>(A)\u00a0 \u00a0<\/strong>On Dated 18<sup>th<\/sup> September 2018 at about 12:56 pm got the email Reference No. 89\/08\/RV\/POCSO\/SE\/DLSA\/18\/13933 Dated 18\/09\/2018 from Delhi Legal Services Authority, South East District, Saket Courts regarding Visiting Rape Victim in FIR No.327\/18 U\/s 376\/34 IPC &amp; Section 6 POCSO Act, PS. Okhla Industrial Area (O.I.A.), where it was stated in the above said email that<\/p>\n<p>\u201cAn Application has been received from the applicant Smt. Bobby Devi, Mother of Victim regarding attending the School i.e. GGSSS, Harkesh Nagar, Delhi for examination by the victim.<\/p>\n<p>You are, therefore, directed to look into this matter and try to settle so that the victim could able to attend the school and give her examination i.e. on 20\/09\/2018 and also sought reason why the victim is not allowed by the School to give examination.<\/p>\n<p>In this regard, you are, advised to submit the report on 19\/09\/2018 at 10:30 am about the response of the School in this matter.\u201d<\/p>\n<p>Signed by Ld. Secretary (Tanvi Khurana)<\/p>\n<p>DLSA (SOUTH-EAST)<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That after getting Telephonic and email instructions from the concerned staff of DLSA\/SE, the undersigned immediately on Dated 18<sup>th<\/sup> September 2018 at around 1:15 pm called the Principal Madam Mrs. Renu Meena and discussed in length the above matter related to re-admission and allowing the victim student for appearing in exams stared from 20\/09\/2018 morning.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That after\u00a0 inquiry it was told by the Principal Madam that the Victim has not been attending her School and missing for more than three month, so as per school rules they have cut the victim name from the role of students from their School after giving two three (2-3) notice by Speed Post and nobody including victim family member turn to School and gave any reason about victim not attending the School.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That it was further told by the School Principal Madam that they have asked the victim family i.e. her mother (Applicant) Smt. Bobby Devi, Mother of Victim for requesting her to submit victim medical certificate or medical documents for reasons not attending the school.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The in-between discussion informed the School authorities that Victim mother has lodged the FIR No.327\/18 U\/s 376\/34 IPC &amp; Section 6 POCSO Act, PS. Okhla Industrial Area (O.I.A.), in which Victim is aggrieved and according to law, procedure and Hon\u2019ble Supreme Court guidelines Any School authority cannot cut the name of the victim (Student) in rape\/POCSO cases in any situations and further they have to re-admit and allow the victim for giving her examination.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That Principal Madam after discussion assured me that she will definitely allow the victim for re-admission and will also allowed her for appearing in exam.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That after lengthy discussion with Principal Madam.\u00a0 I\u00a0 called\u00a0 Smt. Bobby Devi, Mother of Victim on her Mobile and requested her to come tomorrow i.e. 19\/09\/2018 at 8.30 am morning for re-admission and for permission of victim to appear in examination.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 That on Dated 19\/09\/2018 at 9.00 am, undersigned, Victim and her mother Smt. Bobby Devi reached at above said School, where after due formalities School Authorities including Principal Madam allowed the Victim for Re-Admission in same class and section and further allowed the Victim for appearing in her exams to be started from 20\/09\/2018.<\/p>\n<p><strong>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 School Authorities re-entered the name of the victim in the same Class and Section, and thereafter issued her new re-admission number and allowing victim for appearing in exam to be started from 20\/09\/2018.<\/strong><\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 It is pertinent to informed that during the process of getting victim re-entered in same class, discussed the welfare of the victim with her mother and informed about her (victim) Legal Rights and Remedies available from DLSA in above case.\u00a0 I also explained the provision of \u2018Witness Protection Schemes and Victim Compensation Schemes\u2019. Further\u00a0 I in the presence of victim mother complete counselling verbally and requested her not to discontinue victim studies due to above FIR.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Undersigned felt great pleasure after finishing formalities about Victim re-admission and appeared in her Annual Examinations.<\/p>\n<p>*\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 After completion of Telephonic Calls and thereafter Personal Meetings with School Authorities undersigned been able to complete the task\/work given by Ld. Secretary on time.\u00a0 I under\u00a0 instructions given by the Ld.
