SUCCESS STORY OF A MAINTENANCE CASE

          Applicant in this case is Smt. Akhtrai Begum, aged about 80 years, resident of Uldhan Pur, Naveen Shahdara. She is a household worker and had 7 children, including 5 daughters and 2 sons. While doing household chores in neighbourhood, she managed upbringing of all her children, and helped all her daughters settle in their respective matrimonial houses.

          However, in her twilight years, she was being tortured mentally and was not being provided any food, medicine or care by any of her sons. Applicant was distressed of the fact that, she was unable to maintain herself out of her own earning as her health had deteriorated, due to ageing and it was impossible for her to continue doing household works for her survival. Being deprived of her basic rights, she approached the police which advised her to visit District Legal Services Authority (hereinafter called “DLSA”), Shahdara, for free legal support.

          The Applicant approached the office of DLSA and apprised Ld. Secretary about her condition and the fact that none of her sons were ready to take care of her and made her life more miserable. Ld. Secretary assured her that she will be provided adequate legal support from the Authority. Ms. Preeti Thakur, Legal Aid Counsel (hereinafter called LAC), was assigned qua matter in hand and LAC filed an application under Section 125, Code of Criminal Procedure 1973 for grant of maintenance against sons of applicant.

          The Court ordered both sons to pay monthly amount of Rs. 2000/- each to their mother/applicant as a part of her maintenance. The Applicant was very satisfied with the order, and expressed her gratitude to the office of DLSA, Shahdara.
