SUCCESS STORY OF A CRIMINAL CASE

The applicant, in this case was a victim of domestic violence. She along with her differently abled child was deprived emotionally and economically, as her husband (hereinafter called the respondent), refused to maintain his spouse and their only child, due to reasons best known to the respondent. After being mentally harassed for a long period of time, applicant along with her child shifted to her maternal home. The child of the applicant was partially deaf and dumb since birth and the applicant’s plea to the respondent to provide monetary support for the treatment of the child was unheard at all occasions. She was extremely unhappy and feared for the future of her child.

Aggrieved of the ignorance by her husband, she approached the office of District Legal Service Authority (hereinafter called “DLSA”), Shahdara and narrated the entire story to the Legal Aid Counsel (hereinafter called LAC) at the Front Office of DLSA, Shahdara. The matter was immediately brought to the notice of Ld. Secretary, who assigned the case to Sh. Abhishek Kumar, LAC for the MM Panel.

An application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 was filed by the LAC promptly and the Court ordered the Respondent to pay Rs. 5000/- (Five Thousand Only) as ad interim maintenance on the first hearing, giving the applicant a glimmer of hope. LAC further got the matter referred to Mediation Cell to explore possibility of settlement between the parties and to ensure better life and future to the only child of both the parties. Due to positive intervention of LAC concerned both the parties amicably resolved their dispute and thanked him as well as DLSA office for the valuable assistance.
