ln this matter, since working days of the workman with the management was less than 240 days in the preceding year and the actual working-period was about 4-5 months, an effort was made for settling the matter thereby giving full and final settlement to the workman which workman ultimately agreed to after persuasion by the court as well as by the Authorized Representatives for both the parties and hence, the matter got settled.

The management made payment then and there. Statements of parties were recorded and the matter was disposed off.

 Anil Kumar Mishra vs M/s Shiva Scientific Co. &

Kusumwati vs M/s Shiva Scientific Co.

     These are two peculiar case of husband and wife having employed with the management in which case, the employer-employee relationship with the workmen was denied. However, during the evidence and during the period of pre sitting, the proposal for settlement was given and with the active assistance of Ld. ARs Sh. A.V. Shukla, ARW and Sh. R.S. Sahota, ARM and candid approach of management who was appearing in person being a Doctor by profession, agreed to settle both these matters for a total sum of Rs. 1,75,000/- i.e. Rs. 1,00,000/- to Anil Kumar Mishra, Husband and Rs. 75,000/- to Kusumwati, wife and even the

cheques were paid by the management on the same day. But since worklady Kusumwati was not present and workman Anil Kumar Mishra had the apprehension with respect to encashment of cheque, matters were kept pending  for 08.04.2017 i.e. the day on which Lok Adalat was fixed so as to ensure full and final settlement thereby removing the apprehension of workman and worklady.  However, on 08.04.2017, workman and worklady resiled from the statement by

stating that the offered amount is insufficient and was not agreeable to the settlement.

ARW Sh A.V. Shukla was present and with his active assistance and with the persuasion of the court for about one hour, workman and worklady ultimately were made comfortable with the settlement so arrived at and matters were disposed off.
