FIR No. 414/17, U/s 376 IPC & 6 POCSO Act, P.S. Gandhi Nagar

In aforesaid case, a request letter for granting compensation to the prosecutrix was received by DLSA East on 13.09.2017 from the SHO, P.S. Gandhi Nagar, Delhi.

Considering the gravity of offence and the recommendation of SHO, the Secretary immediately directed the IO to appear before him along with the guardians of the victim on 14.09.2017 at 12 noon. In compliance of the said directions, the IO appeared before the Secretary along with the parents of the victim on the given date and time. The Secretary had personal interaction with the guardians of the victim in the chamber in the presence of IO. During interaction, it was resolved that there is an immediate need to provide compensation to the victim. In view thereof, the secretary directed the IO to immediately obtain the relevant documents from the parents of the victim so as to enable them to open a bank account to get compensation amount. The Secretary also deputed one of the officials of this Authority to accompany the IO and the guardians to UCO Bank, Karkardooma Courts, Delhi to facilitate them to open a bank account without any inconvenience.

As a result of the joint efforts of all concerned, under guardianship bank account in the name of the victim got opened at UCO Bank, Karkardooma Courts, Delhi.

Guardians of the victim were made aware that if required at their end, the medical aid can also be provided to the victim. However, they submitted that no such medical aid is required at their end from this Authority. One written application was also submitted by the mother of the victim requesting therein to shift the victim from present school to some other school. Considering the circumstances and safety and protection of the victim, the Secretary accepted the request of the mother of the victim and recommended the shifting of the victim from one school to another to Director (Education Department), East District Municipal Corporation, 419, Udyog Sadan, Patparganj Industrial Area, Delhi immediately. As a result, the victim and her brother, both were shifted to some other school.

Further, the matter was discussed with the members of District Victim Compensation Committee, East, to consider provision of immediate compensation to the victim and therefore, a meeting of the said committee was scheduled for 15.09.2017.

After due discussion during the aforesaid meeting, an amount of Rs. 50,000/- was awarded as interim compensation in favour of the victim.

Further, one LAC of DLSA East was also deputed to help the victim and her guardians in getting representation before the court and other legal help.
