A blue- line bus driver was charged with for the offences u/s 279/304 A IPC in the year 2001 for causing a fatal accident. He was convicted for those offences by Ld. Trial Court in January 2019 and was sentenced accordingly.
The convict approached DLSA (NW) for legal aid for filing an appeal. A Legal Aid Counsel was provided to him and appeal was filed as per law. The Legal Aid Counsel dealt with the matter professionally and adduced remarkable arguments in defence before Ld. Sessions Court. The main argument was that the material on record was not sufficient to prove beyond reasonable doubt that convict/appellant was driving the offending vehicle on the fateful day.
Ld. Sessions Court after considering the arguments from both sides along with the record, allowed the appeal and conviction along with sentence of Ld. Trial Court was set aside.
