I. Background of the Case
Victim “M”, a minor girl aged 15 years at the time of incident, entered into a marital relationship with her boyfriend. Soon after, she became pregnant. However, her husband abandoned her. With no support from her in-laws, she was left to fend for herself while carrying her pregnancy.
She went to the police station to file a missing complaint but, FIR was registered against the accused under Section 376 IPC and Section 6 POCSO Act. The matter was taken up before the Hon’ble Court at Tis Hazari, West District, Delhi.
When the victim first came for counselling on 15.05.2025, she appeared extremely weak and unwell. Her infant daughter was also suffering from ill-health. At that time, she had no shelter and was residing on the footpath near Safdarjung Hospital.
II. Medical and Financial Challenges
The victim faced grave physical and emotional trauma during her pregnancy and after the birth of her child. Living without financial resources, she struggled to provide food, healthcare, and basic necessities for herself and her daughter.
Her father, being a daily wage labourer earning less than ₹5,000 per month, was unable to support her. Due to these conditions, she was completely dependent on the support extended through legal aid and victim assistance schemes.
III. Intervention
On 26.03.2025, the Hon’ble Court considered her case and awarded her an interim compensation of ₹4,12,500/-, with scheduled disbursement to ensure sustained financial support. The immediate release of ₹2,50,000/- enabled her access to medical care and safe accommodation for herself and her infant daughter.
IV. Proceedings of the Criminal Injuries Compensation Board
The Victim Impact Assessment Report confirmed her vulnerability, lack of education, poor financial background, and urgent need for rehabilitation. The Hon’ble Court emphasized that the victim had suffered severe physical and psychological trauma and required rehabilitation measures, particularly since she had to care for her infant child.
The compensation order was passed in compliance of judgment of Hon’ble High Court of Delhi in X vs. State of NCT of Delhi, ensuring maximum benefit to child survivors of sexual abuse.
V. Outcome and Current Status
Through timely legal intervention and counselling, the victim received financial & psychological assistance that enabled her to stabilize her life. With medical and emotional support, she regained her health and began nurturing her daughter in a secure environment.
The proactive intervention of West DLSA at Tis Hazari Court ensured that she received victim compensation without delay, which enabled her to afford necessary medical facilities for both herself and her daughter.
As of now, the victim is living a healthy and dignified life with her child. She has overcome the hardships of abandonment and homelessness, and her daughter is also reported to be in good health.
