In another Success story, I was appointed by this Authority in Reference No. NDDLSA/543/14/LA  in FIR No. 202/2000 PS: Sarojioni Nagar, Under Section 279/304A IPC bearing CC No. 40357/ 2016 titled State versus Rajinder Singh.

This case was of the year 2000 and when I was appointed in this case, Evidences were going on in this case. The accused was a old aged person and has no mean to engage a lawyer to defend himself before the Hon’ble Court. When I got the assignment letter, I immediately inspected the file and came to know the crucial facts of the case and took this case as a challenge for me.

In this case the victim was died after 10 days of the incident and notice under section 251 of Cr. P. C. was framed on the accused under section 304A IPC. I found that most of the witnesses were unexamined and discharged due to lack of defence lawyer. I moved an appropriate application before the Hon’ble Court and the said application was allowed by the Hon’ble Court. I conducted the cross examination of remaining witnesses.

I argued at lenghth on behalf of the accused with the support of the catena of judgment in favour of my client and I completed my arguments that prosecution has failed to prove its case beyond reasonable doubt that the accused was driving the bus in rash and negligent manner and due to which collision took place with scooter which was being driven by the victim who expired due to injuries received in said collision.

Almost all the points raised by me during the argument were duly mentioned by the Hon’ble Court in the judgment and the accused was acquitted under the charges framed against him by the Hon’ble Court.

This case was 18 years old and I am very happy to say that I got justice for a needy and poor person who was at fag end of his life and had no means to engage a lawyer but due to the Free Legal Aid which is being provided by this Authority , he was able to get success in his case was able to save himself from false accusation.
