Secured maintenance to widow from her children who failed to maintain her

Respecting parents and elders and caring them is an integral part of Indian tradition. However, one cannot be oblivious of fact that now a days there is a rampant abuse of elderly people who often suffer the pain and misery at the instance of their own children or close family relations in silence and do not report to the concerned authorities.

One such instance came to light of DLSA Shahdara when a senior citizen, also widow, aged 62 years approached this Authority for legal aid. The lady was reportedly harassed by her 3 children who were not maintaining her and used to often beat her. She was constrained to take alms from neighbourhood and relatives for her livelihood. She was brought to the office of DLSA by PLVs of Shahdara District and the office immediately provided her Legal Aid Counsel Ms. Arti Sharma to file petition for maintenance u/s 125 Cr.P.C from her children. With the sincere efforts made by LAC concerned, the Hon’ble Court passed an order directing children of the said lady to pay a sum of Rs. 3000/- each per month to the victim for her maintenance & basic needs. After that execution petition was also filed to execute the order of Hon’ble Court and the old lady successfully started receiving maintenance amount from her children. She was very happy and thankful to the Authority for timely intervention.
