STORY OF A CASE OF MAINTENANCE

                On dated 21.02.2019 at about 02:30 PM respondent was produced from JC from Agra Jail  as he was also undergoing sentence for an offence u/s 302/498A IPC DLSA Panel Advocate Sh. Dinesh Kumar Gupta duty represented him in court and convinced the court to refer the matter to reconciliation. Both the parties were thus directed to appear before Ld. Counselor Sh. Vijay  Ahluwalia. Legal Aid Counsel of DLSA Shahdara made the sincere efforts to reconcile the dispute with the help of counselor.

The petitioner in the case was unable to maintain herself and her child and respondent being in custody was not giving any maintenance for livelihood of his family. Due to diligence and vast experience of LAC concerned in handling matters of such sensitive nature, the matter got amicably resolved between both the parties in the same day before the counselor. Thereafter, joint statement of both the parties had been recorded. As per the settlement petitioner has received two cheques in the sum of Rs. 40,000/- and Rs. 60,000/- in her favour issued by the respondent and respondent had also undertaken to pay the maintenance by way of cheque in favour of the petitioner for benefit of their son namely master Arpit who was born on 29/10/2002.

The Hon’ble Family Court had passed the order that respondent shall pay the sum of Rs. 12,000/- p.m from the date of filling the petition till Master Arpit gets major.  The court concerned  appreciated the efforts of Panel Advocate of DLSA Shahdara for assisting the court in disposing the matter of such sensitivity in a single day. The parties also thanked the counsel for timely intervention. The case had been published in the national newspaper namely Nav Bharat Times, New Delhi dated 26.02.2019 and Local Newspaper namely Meri Delhi Meri Shaan (Weekly Newspaper) dated 04.03.2019.
